PROTECTION OF CHILDREN: DISCLOSURE OF CRIMINAL BACKGROUND OF THOSE WITH ACCESS TO CHILDREN (THE REHABILITATION
OF OFFENDERS ACT 1974). (EXCEPTIONS) (AMENDMENT) ORDER 1986.
- This post is exempt from the provision of Section 4(2) of the Rehabilitation of Offenders Act 1974 by virtue of the
Rehabilitation of Offenders Act 1974 (Exceptions) (Amendment) Order 1986. Owing to the nature of the work, you are advised
that if offered the post for which you are now making application, the offer will be subject to the School Governors being
satisfied as to your suitability following a check on any record of convictions, bindovers, or cautions held by the Police.
A record with the Police will not automatically result in the withdrawal of the offer, but will be taken into account by the
School Governors in deciding whether the appointment should be confirmed.
- If you are selected for interview, you will be asked to complete a disclosure form and requested to produce several original
ID documents. These will be photocopied and returned to you. Your confirmation of attendance for interview will indicate
acceptance that you will complete the aforementioned form and, if necessary, would be willing to discuss any such
offences at interview. Applicants should, therefore, be prepared to disclose all convictions, bindovers or cautions, no
matter how long ago they happened.
- You should also be aware that the letter addressed to referees named in your application form (or others) will advise them
that under the Order they are at liberty to disclose any convictions/bindovers/cautions which they consider relevant to your
suitability for employment.
- Completion of the form mentioned in (2) above gives consent to the disclosure by the Police of any convictions/bindovers/cautions
to the Governing Body/employer. No disclosure will be sought without your consent, but your application will not be further
considered without it. Attendance for interview will constitute your acceptance of these conditions and a willingness
to comply. Failure to complete the disclosure form will constitute withdrawal prior to interview and remove any entitlement
to expenses for attendance at interview.
- If the declaration provided by the applicant does not accord with information provided by the Police, the applicant will have
an opportunity to discuss the discrepancy with the appropriate member of the School Governors before any decision about the
relevance to the appointment is reached.
